Flexible Raid Lock Mayhem

From http://forums.worldofwarcraft.com/threa ... 4753&sid=1, it's a long and terribly confusing thing. But here's one snippet which should clear up that thing about Heroic/Hardmodes that came up Tuesday:
But let's say you are a member of a Heroic raid in Icecrown Citadel, and after killing Lord Marrowgar on Heroic you have Internet connection issues that prevent you from raiding for two nights. During those two nights, the rest of the raid kills everything. Without the Flexible Raid Lock system, you would be done with raiding Icecrown Citadel for the week. Ouch. With the Flexible Raid Lock system, you can join someone else's raid as long as they are doing Normal difficulty. This would at least give you the opportunity to earn your Justice Points for the week. If this raid attempted to switch to Heroic difficulty for Icecrown Gunship Battle with you in the raid, the raid leader would receive an error message stating that she cannot change to Heroic, because someone in the raid (i.e., you) is already locked to a different Heroic instance.

So from this quote I see the following.

1) You can only ever kill any boss once per week - heroic or normal.
2) If you kill at least one heroic boss, you may not enter another heroic raid to kill unkilled heroic bosses
3) If you kill at least one heroic boss, you may still enter a raid for normal bosses with another raid group for other non-killed bosses.
- If this normal raid tries to set to heroic, they will be unable due to you being in the raid.

Something I saw from a previous blue post (which I might misunderstand, which is why I bring it up).
4) if you join a raid further progressed than you, you will be saved to their current progress once you kill a boss in their raid.

So in our current situation:
We've downed 9 bosses in ICC. We only have DW, Syn, and LK left. Any of us may enter a new raid to kill any of these three bosses on normal. If this new raid tries to set to heroic, they will be unable to. We are unable to join a new heroic raid.

Question: What makes a heroic raid: Does Tex own the raid lock? So he can bring 9 other people into our heroic instance if he wanted to ? That would be consistent the previous raid lock system.
